Man Gets Probation for Pollution

Michael P. Guesman 35, of Cortland, Ohio was placed on 3 years probation and received 300 hours of community service in a plea agreement with the U.S. Attorney’s office out of Cleveland.

Guesman, who worked for Youngstown based  Hardrock Excavating, had been dumping brine and drilling mud numerous times into a storm sewer that drained into a tributary of the Mahoning River in 2012 and 2013.

Ben Lupo, owner of Hardrock Excavating is also facing federal charges for violating the Clean Water Act. In the event that Lupo goes to trial, Guesman will be required to testify against him as a stipulation of his plea agreement with the U.S. Attorney’s office. Lupo is facing up to 3 years in prison and a $250,000 fine.
